These Terms & Conditions constitute a legally binding agreement between you ("the Guest" or "you") and Mzansi Safari Tours (Pty) Ltd, a company registered in the Republic of South Africa.
These terms apply to all tours, packages, transfers, day trips, add-ons and any other services booked through our website, WhatsApp or any other channel.
If you are booking on behalf of a group, you represent and warrant that you have the authority to accept these terms on behalf of all members of the group, and that each member is bound by them.
Bookings may be made via our website, WhatsApp or email. A booking is confirmed only when:
All bookings are subject to availability. We reserve the right to decline any booking at our discretion. Enquiries submitted through our website or WhatsApp do not constitute a confirmed reservation until confirmed in writing by us.
You are responsible for providing accurate and complete information at the time of booking, including the number of guests, travel dates, pickup location and any special requirements. Errors in information provided may affect service delivery and any resulting costs shall be borne by you.
Guests under the age of 18 must be accompanied by a parent or legal guardian. Certain activities (e.g. Atlantis Dunes motorbike riding) have minimum age requirements set by the activity operator, which we will communicate at time of booking.
All prices displayed on our website are in South African Rand (ZAR) and are subject to change without notice. The price applicable to your booking is the price confirmed in writing at the time of your booking confirmation.
Prices are per person unless otherwise stated. Package prices are based on the number of guests specified at the time of booking.
Each tour package clearly states what is included and excluded. Entry fees to attractions, meals, gratuities, international flights, travel insurance and items of a personal nature are excluded unless explicitly stated as included.
Payment terms will be communicated at time of booking. We may require:
Accepted payment methods will be confirmed during the booking process. Prices quoted in foreign currencies are indicative only — all payments are processed in ZAR.
We reserve the right to adjust prices to reflect changes in fuel costs, accommodation rates, activity fees, exchange rates or government taxes. Any price change applicable to a confirmed booking will be communicated to you promptly.
We reserve the right to cancel or modify any tour due to:
In the event of cancellation by us, we will offer either a full refund of payments made or an alternative date/tour of equivalent value. We are not liable for any additional costs you may incur as a result of such cancellation (e.g. flights, accommodation).
Approved refunds will be processed within 10–14 business days via the original payment method.
Requests to change travel dates, tour type or guest numbers must be made in writing as early as possible. We will accommodate changes where operationally possible. Changes made within 48 hours of departure may not be possible and may be treated as cancellations.
We may, on occasion, need to make minor changes to itineraries due to weather, road conditions, attraction closures or other operational factors. We will endeavour to provide equivalent alternatives where possible and will inform you of significant changes as soon as practicable.
Guests are expected to behave in a respectful and responsible manner at all times. We reserve the right to terminate a tour and remove any guest who:
In such cases, no refund will be provided and the guest will be responsible for any additional costs incurred to arrange alternative transport.
Guests are responsible for any damage they cause to vehicles, equipment or third-party property during the tour.
To the maximum extent permitted by South African law, Mzansi Safari Tours shall not be liable for:
By booking with us, you agree to indemnify and hold harmless Mzansi Safari Tours, its directors, employees, guides and contractors from and against any claims, liabilities, damages, losses or expenses arising out of or in connection with your participation in any tour or activity, to the extent permitted by law.
Nothing in these terms limits or excludes rights you may have under the Consumer Protection Act 68 of 2008 or any other applicable South African legislation that cannot be lawfully excluded.
You are responsible for ensuring that you and all members of your group are fit and healthy enough to participate in your chosen tour or activity. Please inform us of any relevant medical conditions, disabilities or dietary requirements at the time of booking.
We strongly recommend that all guests obtain comprehensive travel insurance prior to travelling, covering:
Mzansi Safari Tours does not provide travel insurance and is not responsible for costs that would otherwise be covered by such a policy.
Guests must follow all safety instructions given by guides, drivers and activity operators at all times. Failure to do so may result in exclusion from the activity and the guest's safety obligations will not be our responsibility.
Published itineraries are intended as a guide only. Actual routes, attraction visits and activity timings may vary due to weather, road conditions, seasonal variations, attraction operating hours or other factors outside our control.
Certain attractions (such as Table Mountain Cable Car) operate subject to weather conditions and may be temporarily closed. In such cases we will suggest suitable alternatives but cannot guarantee entry.
We endeavour to start and end tours at the agreed times. However, travel times in Cape Town may be affected by traffic and we cannot be held liable for delays.
Some elements of our tours involve third-party service providers such as hotels, cable car operators, wine estates, ferry operators and adventure activity companies. These providers operate under their own terms and conditions, which you may be required to agree to directly.
We act as an agent or facilitator in arranging these services and are not liable for the actions, omissions or quality of service provided by third parties, beyond our reasonable duty to select reputable providers.
All content on our website and marketing materials, including text, photographs, logos, graphics and tour descriptions, is the property of Mzansi Safari Tours (Pty) Ltd or its licensors and is protected by South African and international copyright law.
You may not reproduce, distribute, republish or commercially exploit any content without our prior written consent.
Photographs and videos taken during our tours may be shared for personal use. We occasionally photograph tours for marketing purposes. Please inform your guide if you do not wish to be photographed.
These Terms & Conditions are governed by and construed in accordance with the laws of the Republic of South Africa.
Any dispute arising out of or in connection with these terms shall first be subject to good-faith negotiation between the parties. If unresolved within 30 days, the dispute may be referred to the applicable South African court of competent jurisdiction.
